Will a Ticket Violate My Probation?

by Richard Jones  - June 6, 2023

Most probations or deferred dispositions require that you not commit any new offenses. While a ticket is a relatively low level of offense, it’s still an offense. You should do anything to jeopardize the hard work you’ve put in to this point. Contacting a lawyer can save you from a hearing or a revocation of your probation.

Now, all tickets are not created equal. If you receive a speeding ticket while on probation for marijuana, it may not be a big issue; but a ticket for speeding while on probation for a driving offense, such as racing or driving on an invalid license, may be grounds for revocation or the imposition of other sanctions. Those sanctions could include jail time, an increase in the length of probation, additional community service, or some combination of all three. Likewise, urinating in public might not seem that terrible, but it’s usually linked to drinking. That could cause problems for drug probations and DWI probations.

If your deferred is set aside and you receive a conviction, your criminal history is affected for the rest of your life. That’s a high price to pay for what is otherwise a relatively minor transgression. Over the years, I have been able to evaluate the complicated factors involved and to help clients avoid the possible dire consequences.
