Racing can be found in the Transportation Code under section 545. Generally racing on a highway is a Class “B” misdemeanor punishable by up to six months in jail. The punishment range is increased based on whether the person has been previously convicted of racing, whether the person was intoxicated and whether someone was injured or killed.

If someone was killed, the punishment range is two to twenty years in prison. Many times a first time racing offense may be reduced to a ticket with the help of a lawyer if the person accused of racing performs community service and defensive driving.
