A person commits the offense of public intoxication is if the person appears in a public place while intoxicated to the extent that he may be a danger to himself or others. Danger can be very broadly interpreted. For instance, if you could get robbed, then you are a danger to yourself.

If you could stumble in traffic, you are a danger to yourself. Public intoxication is a class “C” misdemeanor punishable by fine only. However, if someone has been convicted multiple times within a year, then the offense is a class “B” misdemeanor punishable by up to 180 days in the county jail.
