Not all crimes or offenses are contained in the Texas penal code. Drug offenses are generally found in the Health and Safety Code. Driving offenses, other than DWI, are found in the Transportation Code. Many other offenses are scattered throughout the various code.
The Penal Code covers most “traditional” crimes such as theft, assault and murder. It also contains the punishment ranges for felonies and misdemeanors. Just because certain conduct isn’t listed in the Penal Code, doesn’t mean that conduct isn’t a crime.
