Do You Have A Right To Have A Lawyer?

– AD, Texas

Yes. You have a right to have a lawyer present at any questioning after you have been arrested. This is a right you must ask for. In other words, if you don’t want to be asked any questions other than your name, you must ask for a lawyer.

Once you ask for a lawyer, if the police continue to ask you questions, your answers could not be used against you in any court proceeding. Note that if you are charged with DWI for example, and you are later suspected of a different crime such as drug possession you must ask for an attorney again.

The best thing to do is ask for a lawyer any time you are arrested in Austin and any time the police ask you questions after you have been arrested.
