Can I Go See My Girlfriend or Spouse If She Calls Me & There’s A Protective Order?
– HI, Texas
Answer:
Absolutely not. The only person who can allow you to see a person covered under a protective order against you is a judge. If the girlfriend or wife calls you up and the police come out, you will be arrested.
Never, ever go see someone covered by a protective order against. If they come to where you’re staying, don’t let them. If you see them coming down the sidewalk, turn around and go the other direction. If you’re in a restaurant and they come in, get up and leave.
You lose all benefit of the doubt if you’re in the same location as the other person. You don’t want to spend any time in jail because you were in the wrong place. I had a client on probation who violated a stay away condition because his girlfriend called him over.
They got into an argument and the neighbors called the cops. He didn’t hit the girlfriend and she admitted that she invited him over. He spent six months in jail for that and almost had his probation revoked.
