Aggravated Kidnapping

What Is The Punishment For Aggravated Kidnapping?

– RJ, Texas

The punishment for aggravated kidnapping is a five to ninety-nine years in prison or life (a first degree felony). However, if the victim is released in a safe place, the punishment is two to twenty years in prison ( a second degree felony).

This is to encourage kidnappers to release their victims. Because otherwise the punishment is the same for murder. Without a reduction in punishment, the kidnapper might as well kill his victim to cover up the crime because the punishment is the same. This assumes of course that the kidnapper knows the law.
