Depending on the circumstances surrounding your driving while intoxicated (DWI) case, you may face a suspension of your driver’s license for anywhere from 90 days to 2 years. Additionally, courts may order first time offenders, and will require multiple offenders, to install an Ignition Interlock Device (IID) on their vehicle. IIDs may also be ordered by courts as a condition of a convicted offender’s probation.
An IID is essentially a breathalyzer that will be installed in your vehicle. In order to start your vehicle, you must first submit a breath sample to the IID. If there is any measurable amount of alcohol, or if your blood alcohol concentration (BAC) is higher than the .08% legal limit, you will not be able to start your vehicle. Drivers will also be required to submit breath tests periodically while operating the vehicle.
Courts will notify the Texas Department of Public Safety (DPS) if you have a driving restriction and a requirement to only operate vehicle with an IID installed. If you do not install an IID in your vehicle and obtain a restricted interlock license within 30 days of receiving the DPS notice, you driver’s license will be suspended and only eligible to be lifted by a court order. There are also certain installation, calibration and reinstatement fees associated with the IID that you will be required to pay.

These include the installation of an IID on your vehicle, payment of installation and license issuance fees, and submission of compliance documents, including an SR-22. While the circumstances surrounding the IID process may be burdensome, they will allow you to preserve your driving privileges and avoid the detrimental effects associated with a full license suspension.
