There are a wide variety of punishment ranges for assault offenses in Austin and Travis County. The important factors, as in many possible punishments, is the person’s criminal history in general, any prior assaults by the person, the nature of the assault (i.e. was strangulation or a weapon involved).

If you touch someone without causing them and they didn’t want to be touched, that is punishable by fine only. If you attack a family member you could receive up a year in jail. If you’ve been previously convicted of family violence then the punishment range is two to ten years.

If you’re accused of three acts of family violence in twelve months, the punishment range is two to ten years.

If you use a weapon in a threatening manner, such as waving a knife at someone, that’s aggravated assault and again the punishment range is two to ten years. Note that in most cases, unless you have a prior felony conviction, you may be eligible for probation.
