Can I Get Credit On My Automatic License Revocation If I Get DWI Probation?

– TR, Texas

Answer:

If get convicted of a first time DWI in Austin, your license will be suspended. If your license was previously suspended because of a refusal to take a breath test or because you blew over the limit, you can get credit for that time against the suspension for your DWI conviction.

For example if your license was previously suspended for 90 days and your conviction calls for a 180 day suspension, the judge can give you credit and your license will only be suspended for an additional 90 days. You must ask for the credit.
