A few years ago I was sitting in municipal court. Unfortunately, I was there waiting on my own speeding ticket. The prosecutors were generally being nice to all the folks who were there. I overhead one person who charged with two public intoxications talking to a prosecutor.

The prosecutor told him that he could do community service and have them dismissed or he could pay a reduced fine and be convicted of both. I was going to be a nice guy and tell him he should do the community service because if you have been convicted two or more times for public intoxication, his next could be enhanced to a class “B” (punishable by up to 180 days in jail).

People charged with public intoxication enhanced don't get tickets, they go to jail. I was waiting for the right moment to tell him this, when he started mouthing off at the prosecutor. I didn't like his attitude so I kept my mouth shut. He took the convictions.

Given that he had gotten two public intoxications in a short time, odds are he was likely to get another one. Except he was going to go to jail. I don't like to see people go to jail for public intoxication, but I don't have to volunteer to help rude people.
