What Is The Penalty For Prostitution?

- RJ, Texas

Answer:

Prostitution is a Class “B” misdemeanor punishable by up to 180 days in the county jail unless the person charged has been previously convicted of prostitution. If they have one or two previous convictions then the punishment is for a Class “A” misdemeanor with up to one year in the county jail.

If they have been convicted three or more times then the punishment is for a state jail felony, 180 days to 2 years in the state jail. The punishment is the same whether the person is offering to engage in sexual conduct for a fee or is offering to purchase those services.
